1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the websites, services, and products operated by Stratford Wood Works LLC, d/b/a 3D Print on Demand ("3D Print on Demand", "we", "us"), including but not limited to 3dprintsfast.com, 3dprintondemand.com, 3dprinterondemand.com, gulpdust.com (each a "Site" and collectively the "Sites").
By accessing the Sites or placing an order, you agree to be bound by these Terms, our Privacy Policy, our DMCA Policy, and any other policies referenced herein.
2. Service Description — Custom Manufacturing Per User Direction
3D Print on Demand operates a custom manufacturing service. When you submit a digital file or catalog selection through our Sites, you are directing us to fabricate a physical item to your specification using automated or semi-automated manufacturing processes (including third-party print-on-demand partners).
We are not a publisher, curator, or editorial review service for user-submitted content. We do not review user-submitted files for copyright, trademark, design patent, or other intellectual property concerns. Our role is strictly to execute the manufacturing instructions you provide.
User-submitted files uploaded to our custom-upload flow are:
- Stored only as long as necessary to fulfill your order (typically 60 days after shipment, after which the file is automatically purged from our systems — see our Privacy Policy)
- Not made available to other users or the public
- Not used for any purpose other than fulfilling your order, except where anonymized technical data (file weight, estimated print time) is used to improve pricing and process estimates
3. User Representations and Warranties
By submitting any file ("User Content") to our Sites — whether through our custom-upload flow, a design configurator, or any other submission mechanism — you represent, warrant, and covenant that:
- Ownership or license. You are the sole copyright holder of the User Content, OR you hold a valid license authorizing reproduction of the User Content for the purpose of manufacturing physical copies for personal use, OR the User Content is in the public domain.
- No third-party rights infringed. The User Content does not infringe, misappropriate, or otherwise violate the intellectual property, trademark, publicity, privacy, or other rights of any third party, including but not limited to copyright holders, trademark owners, and design patent holders.
- Lawful purpose. You will not use the Sites to manufacture items that are unlawful, promote violence, infringe on intellectual property rights, or violate any applicable law or regulation.
- Accuracy of information. All information you provide (shipping address, payment details, file metadata) is accurate and complete.
- Capacity to contract. You are at least 18 years old and have the legal capacity to enter into these Terms.
4. License You Grant Us
For the limited purpose of fulfilling your order, you grant 3D Print on Demand and its manufacturing partners a non-exclusive, royalty-free, worldwide license to store, copy, process, and fabricate physical items from the User Content you submit. This license terminates automatically upon purge of the file from our systems.
We do not claim any ownership of your User Content. You retain all rights.
5. Indemnification
You agree to indemnify, defend, and hold harmless 3D Print on Demand, its officers, employees, agents, and manufacturing partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or relating to:
- Your User Content (including any claim that your User Content infringes, misappropriates, or violates third-party rights)
- Your use of the Sites
- Your breach of these Terms or any representations or warranties you have made
- Any unlawful use of the manufactured items
This indemnification obligation survives termination of these Terms.
6. DMCA and Intellectual Property Complaints
3D Print on Demand complies with the Digital Millennium Copyright Act (DMCA) and responds to valid takedown notices. If you believe your copyrighted work has been reproduced through our Sites in a way that constitutes infringement, please follow the procedure set forth in our DMCA Policy.
We reserve the right, in our sole discretion, to:
- Refuse to fulfill any order we reasonably suspect involves infringing content
- Cancel orders already in progress upon receipt of a valid infringement claim
- Terminate accounts of users we determine to be repeat infringers pursuant to our DMCA Policy
7. Orders, Pricing, and Fulfillment
- Orders are confirmed upon payment and not before
- Prices are as quoted at the time of order; quotes for custom uploads are calculated automatically by our pricing engine and are valid for the duration of the checkout session
- We reserve the right to refuse or cancel any order for any reason, including (but not limited to) suspected infringement, pricing errors, or inability to fulfill
- Estimated delivery times are estimates, not guarantees
- Shipping is via carriers selected by our manufacturing partners. Title and risk of loss transfer to you upon delivery to the carrier
8. Returns, Refunds, and Defects
Because items are manufactured to your specification, we generally do not accept returns except in the case of manufacturing defects or shipping damage. If your order arrives defective or damaged, contact us at support@3dprintondemand.com within 14 days of delivery with photographic evidence and we will arrange a replacement or refund at our discretion.
9. Disclaimers
THE SITES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. 3D Print on Demand SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (A) THE SITES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY PRODUCT WILL MEET YOUR EXPECTATIONS; OR (C) ANY USER CONTENT YOU SUBMIT IS FREE OF THIRD-PARTY RIGHTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3D Print on Demand AND ITS OFFICERS, EMPLOYEES, AGENTS, AND MANUFACTURING PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING TO YOUR USE OF THE SITES OR ANY PRODUCT.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID 3D Print on Demand IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles.
Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in Essex County, New Jersey or via video conference at 3D Print on Demand's option. You waive any right to a jury trial and any right to participate in a class action.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on the Sites with a revised "Last updated" date. Continued use of the Sites after a change constitutes acceptance of the revised Terms.
